The top doctor for the Oregon Department of Corrections is facing charges of driving under the influence of intoxicants.
Bend resident Christopher Peter DiGiulio, 52, clinical director for the Department of Corrections, was arrested on Dec. 2 for investigation of DUII and for refusing to take a breath test for alcohol — both misdemeanors.
DiGiulio was pulled over in his white BMW on NE Third Street near Wilson Avenue because his rear running lights were out, according to the arrest narrative by Bend Police Officer Aaron Myers.
A related search warrant affidavit states DiGiulio admitted to the arresting officer that he smoked marijuana earlier in the day.
DiGiulio was arraigned Tuesday in Deschutes County Circuit Court.
His next court date is scheduled for Feb. 16.
DiGiulio’s attorney, Bryan M. Donahue, said a decision on opting for alcohol diversion treatment remains open.
“Between now and his next court date, we’ll be reviewing the best course of action for him,” Donahue said. “At that time, we’ll make a decision on how to proceed.”
A representative for the Department of Corrections confirmed DiGiulio is a full-time employee.
DiGiulio’s license with the Oregon Medical Board is listed as active.
The board’s Executive Director Kathleen Haley said licensed physicians in Oregon must report misdemeanor arrests upon conviction. Felonies, however, must be reported at arrest. Board subcommittees review arrests and occasionally recommend substance abuse evaluation or other intervention.
DiGiulio made statewide news in May when the person who hired him at the Department of Corrections was investigated for offering him the position before the application period had formally closed.
